【セミナーの目的】本セミナーは「ハード・ローとソフト・ローの交錯(Intersection between Hard Law and Soft Law)」をテーマに、ハード・ローとソフト・ローの関係性について考えることを目的とする。 
【セミナーの目標】ハード・ローとソフト・ローという視点から、多様な規制手段や履行過程を理解した上で、これらの分析視点を各自の研究テーマに使えるようになることを目標とする。

【Course Aim】This seminar is designed to address the intersection between hard law and soft law. The seminar addresses various analytical perspectives regarding the relation between hard law and soft law, and how the relation has been evolved.
【Course Objective】By the end of this seminar, students will be able to understand various regulatory instruments and implementation processes and apply the analytical perspectives of different legal forms (i.e. hard/soft law) to your own research topic.

(1)セミナーの前半は、「ハード・ローとソフト・ローの交錯」に関する文献を読んで議論し、
(2)セミナー後半は、各自の研究テーマを「ハード・ローとソフト・ローの交錯」の視点から捉えたプレゼンテーションを行い、全員で議論する。

◎ 毎回、次回セミナーの課題をだすので、その課題について考えて取り組んでくること。

This seminar is organized as follows:
(1) in the first half of the seminar, we will undertake assigned readings and discuss the intersection between hard law and soft law,
and
(2) in the second half of the seminar, each participant will make a presentation of own research topic in light of the intersection between hard law and soft law, and participants will make comments each other.

◎  At each class, discussion questions to prepare for the next seminar are set out for assignment.

履修条件・関連する科目
成績評価の方法と基準
①平常点(出席と議論への参加)50%、②プレゼンテーションの評価50%、の合計で成績とし、100点満点で60点以上を合格とする。毎回のセミナーにおけるディスカッションへの参加は、すべての学生に期待される。合格の基準は、合格の基準は、ハード・ローとは異なるソフト・ローの特性を理解し、自己のテーマをその視点から分析できるかどうかである。
This seminar is assessed by two components: (1) seminar attendance and discussion participation: 50 % and (2) presentation: 50%.
The score above or equal to 60 is a passing grade. Participation in class discussions is expected of all students. To receive a passing grade, students must understand features of soft law and be able to analyze your own topic in light of the relation between hard law and soft law.

教科書は指定しないが、セミナーの中で適宜、リーディングを指示する。例えば、以下のような文献を扱う予定。
・Kenneth Abbott and Duncan Snidal, “Hard and Soft Law in International Governance,” 54 International Organization 421 (2000).
・Dinah Shelton ed., Commitment and Compliance: The Role of Non-Binding Norms in the International Legal System (Oxford University Press, 2000).
・John J. Kirton & Michael J. Trebilcock, Hard Choices, Soft Law: Voluntary Standards in Global Trade, Environment and Social Governance (Routledge, 2004).

There is no principal textbook that is required to purchase for this class, however, reading materials are to be informed during class. A tentative reading list includes following materials:
