As a material for this purpose, we will examine legal phenomena in the former Soviet Union, Eastern Europe, and other countries in transition from the perspective of comparative constitutional law. |

授業の内容や構成
Course Content / Plan | | ソ連・東欧諸国における社会主義体制の崩壊の後、この地には新たな憲法体制が誕生した。この重大な社会的転換は、憲法において人権を最高の価値と宣言し、憲法裁判所を設置した点によく表れている。しかし、現在、中東欧諸国あるいはかつての旧ソ連構成諸国において、このような憲法上の変容に対する激しい抵抗が生じている（例えば、ロシア、ハンガリー、ポーランドなど）。さらに、西欧諸国においても現代立憲主義の価値に対する懐疑的な姿勢が見られるようになっている。このゼミナールでは、「拡大欧州」で近年生じているこのような憲法上の問題について検討を加える。
After the demise of the socialist regimes in the USSR and Eastern Europe, new constitutional orders emerged in this area. This profound social transformation was well represented by declaring human rights to be the highest value in their constitutions and establishment of the Constitutional Courts. But now we witness harsh “back rash” against such constitutional changes among Eastern and Central European countries and former Soviet Republics. At the same time, such skepticism about the values of modern constitutionalism is also observed in Western European Countries. This seminar will examine such constitutional issues that have recently unfolded in the “enlarged” Europe.

Course Evaluation Method and Criteria | | ・このゼミナールでの報告および発言の内容により成績評価を行います。
・①体制移行諸国の法現象を比較法の視点から分析するために必要な知識を習得し、②自らの報告の主題について的確に検討、紹介し、③ゼミでの討論に積極的に参加したかどうかを、合格の基準とします。
Reports and active participation in discussions. The criteria for passing the course are (1) mastering the basic knowledge necessary to analyze legal phenomena in countries in transition from the perspective of comparative law, (2) accurately examining and introducing the subject of his/her own report, and (3) actively participating in the seminar discussions. |
