授業の目的　【日本語】
Goals of the Course(JPN)

民法・商法・民事訴訟法・消費者法・労働法・経済法などの分野について、新しい最高裁判所の判決を中心に、民事判例研究を行う。また、民事法分野を中心とする研究報告を行う。

本演習は、判例検討を通じて、民法の現代的問題を自ら分析する能力を身に着けることを目的とする。

Goals of the Course

In this seminar, latest judgments of the Japanese Supreme Court in the field of civil law and other related fields will be dealt with. There will also be research reports by the participating students and professors.

The aim of this seminar is to acquire ability to analyze contemporary issues of civil law through investigation of judicial precedents.

-obtain ability to solve legal questions.
-obtain ability of the legal study.
-describe and explain in the fields of civil law.

授業の内容や構成
Course Content / Plan

1. ガイダンス　本演習で扱う判例について参加者と相談のうえ決定する。日程も参加者と相談のうえ決定する。
2-15. 参加者による判例報告を行う。場合により、参加者が執筆した論文の報告会に代えることがある。

特にないが、指導教員と相談の上履修すること。

成績評価の方法と基準
Course Evaluation Method and Criteria

M1前期：毎回の研究会においてレポートを指導教員に提出することによって単位を認定する。

M1後期：研究会で判例報告を行うことによって単位を認定する。

M2前期：修士論文の研究テーマに関する研究報告を行うことによって単位を認定する。

上記以外：毎回の研究会においてレポートを指導教員に提出することによって単位を認定する。

レポートにおいては、報告について内容を理解し当該テーマについて自ら考える能力が身についていることを合格の基準とし、報告については研究テーマについて十分な調査を行って議論を分析し、自ら新しい問題について考えることができる能力が身についていることを合格の基準とする。
