グローバル化社会に対応するための専門的知識を習得し、日本法に関する理解を深めるための比較の素材として、旧ソ連邦およびロシア連邦の法現象について学ぶ。

In order to acquire expertise in dealing with a globalized society and deepen the understanding of the basic features of Japanese law, the legal issues in the former Soviet Union and the Russian Federation are taken up as a source of comparative study.

授業の内容や構成
Course Content / Plan
本講義では、現代ロシア法の特質を、憲法と司法制度を中心に概説する。体制転換期におけるロシアの重大な課題の一つが、法治国家の創出、すなわち法によって政治権力を縛るシステムを構築することにあった。この四半世紀の間にそうした課題がどのように扱われたのかを、制度と実態の両面から検討することにより、日本法の特質について理解を深めるための比較材料を提供する。

   講義の総括

In this lecture, we will learn the characteristics of modern Russian law, by focusing on the constitution and the judicial system. One of Russia's significant challenges during the transition period was to create a rule-of-law state, that is, to build a system that binds political power by law. We examine how such issues were handled in the last 30 years, both institutionally and in practice.
Compared to Russia, the constitutional practice of Central European countries (Hungary and Poland), is also discussed.
Through these works, we will obtain basic knowledge to deepen our understanding of Japanese law characteristics.

Course Evaluation Method and Criteria
学期末の筆記試験によって評価する。
ロシアの法現象についてまとまった考察・論述ができるだけの基礎的なロシア法の知識が修得されていることを合格の基準とする。なお、定期試験に欠席した者は「欠席」、出席のうえ不合格となった者は「F」とする

現代ロシア法については、小森田秋夫編『現代ロシア法』(東京大学出版会、2003年)、小田博『ロシア法』(東京大学出版会、2015年)がある。
ソ連時代は、藤田勇『概説ソビエト法』(東京大学出版会、1986年)を参照のこと。
ロシア連邦憲法の邦訳は、畑博行・小森田秋夫編『世界の憲法』第5版(有信堂高文社、2018年)所収の拙訳を参照されたい。優れた入門書として、ロシア法全般については、渋谷謙次郎『法を通してみたロシア国家』(2015年、ウェッジ)が、商事法については、松嶋希会『ロシア・ビジネスとロシア法』(商事法務、2017年)がある。
