Goals of the Course(JPN) | | | 講義の目的は、資本主義経済による社会の発展と社会秩序を維持するための警察国家の拡大という、近代日本の天皇制国家の特徴を理解してもらうことにある。そのため、明治から占領期までの刑法の大逆罪、不敬罪の制定・運用を取り上げ、最新の研究成果をふまえ解説する。警察国家による社会統制の具体的実態について理解することは、単に特定の国家体制史を学ぶということに止まらない、権威主義体制を成立させている国家制度上の要因を理解するという意義がある。 |

Goals of the Course | | | The purpose of this lecture is to provide students with an understanding of the characteristics of the modern Japanese imperial state: the development of society through a capitalist economy and the expansion of the police state to maintain social order. For this purpose, the enactment and application of the Crimes of High Treason and the Crimes of Impunity in the Penal Code from the Meiji era to the Occupation era will be discussed and explained based on the latest research findings. Understanding the specific realities of social control by the police state is not merely a matter of learning the history of a particular state system, but also has the significance of understanding the factors in the state system that make authoritarian regimes possible. |

The ultimate goal of this course is for students to be able to conceive of issues by connecting history and the present, to discover issues on their own, and to argue about them based on materials and other sources. |

授業の内容や構成
Course Content / Plan | | ＜概要＞近代天皇制国家史を時期区分ごとに概説する。政治体制レベルの変化に加えて、天皇制国家権力による社会統制の側面にも焦点を当て、大逆罪と不敬罪の制定及び運用の拡大的変化について解説する。教科書の『天皇制国家の専制的構造』の著者である渡辺治氏（一橋大学名誉教授）をゲスト講師として招き、大逆罪、不敬罪の制定、運用の変化について解説していただく予定である。

２ 名望家層による政治社会の生成：自由民権運動、国会開設運動、明治14年政変
３ 大逆罪と不敬罪①：明治13年刑法における大逆罪と不敬罪の制定
４ 初期議会の攻防：藩閥政府と民党、1900年体制、明治社会主義運動
５ 大逆罪と不敬罪②：警察国家の法と執行体制、大逆事件
６ 政党政治確立期：大正政変、第1次大戦と政党政治の確立
７ 大逆罪と不敬罪③宗教d団体への弾圧
８ 政党政治全盛期：政党内閣制の成立と利益政治
９ 立憲君主制崩壊期：政党排撃運動、天皇機関説排撃運動
10 大逆罪と不敬罪④：ファシズム期の宗教弾圧
