授業の目的 【英語】
Goals of the Course | | | One of the main challenges in reforming the judicial system in Asian (former) socialist countries, which are implementing marketization, is to overcome the old legal systems inherited from Soviet Law. Through this course, students will be provided with the expertise on Soviet and Russian law and thereby they will obtain the ability to analyze the problems that need to be solved through legal reform projects in recipient countries of legal assistance in a framework of international development cooperation. |

授業の内容や構成
Course Content / Plan | | この授業は、講義形式で実施する。
講義においては、ソビエト法およびロシア法を対象として、その司法制度や審級制度を支える基本理念（適法性、実体的真実主義など）、法解釈に対する姿勢などを紹介することにより、法整備支援対象国の法制度の根底に存在する法をめぐる考え方の特徴を明らかにする。また、そのような制度、原則がどのような背景で生じたのかをめぐる概観するとともに、ロシアにおける体制転換の過程で旧来の法制度がどのように変容したのか、あるいは変容しなかったのかについても検討する。
This course will be conducted in a lecture style.
In the lectures, the basic principles (socialist legality, material truth principle, etc.) and approaches to legal interpretation that underpin the judicial and procedural systems of Soviet law will be introduced in order to clarify the core attributes of the ideas about a law that underlie the legal systems of the recipient countries of the legal assistance. It will also touch on the theoretical perspectives on the background of such systems and examine how the old legal systems were or were not transformed during Russia's social regime change.

成績評価の方法と基準
Course Evaluation Method and Criteria | | 講義の中で合計3回課される小レポートの内容（45％）および、講義への姿勢（発言、質疑）(55%)をもとに成績評価を行う。それぞれについてC-またはC（該当する場合）以上を合格要件とする。
Evaluation of grades will be based on the contents of the short reports assigned three times in a semester (45%), as well as ordinary participation in the lecture (comments and questions) (55%). Credit is given of C- or C（where applicable）or higher for each graded criterion. |
