授業の目的 【英語】 Goals of the Course | | The contract of sale is the backbone of international trade in all countries, irrespective of their legal tradition or level of economic development. The United Nations Convention on Contracts for the International Sale of Goods (in short, CISG) is therefore considered one of the core international trade law conventions whose universal adoption is desirable. The adoption of the CISG provides modern, uniform legislation for the international sale of goods that would apply whenever contracts for the sale of goods are concluded between parties with a place of business in Contracting States. By doing so, it aims at avoiding the recourse to rules of private international law to determine the law applicable to the contract, adding significantly to the certainty and predictability of international sales contracts. The course will present in detail the key features of the CISG, also by employing cases taken from real life legal practice. |

成績評価の方法と基準 Course Evaluation Method and Criteria | | 50% contribution to the discussion 50% Written tests (mid term and final). Pass: Credit is given for C In order to pass, students must need to demonstrate a basic understanding of the key principles of the CISG: sphere of application, obligations of the seller and of the buyer, remedies available in case of breach. Students need to take both the mid term and final test to pass. Students need to take both the mid term and final test to pass. In case they are unable to attend either, they must contact the instructor in advance. |

教科書・参考書 Textbook/Reference Book | | Due to the peculiar nature of the seminar, there is no need of a general textbook for students. Lessons will be based on readings that will be distributed to students in advance via the TACT system. |

授業開講形態等 Lecture format, etc. | | 原則として対面で行う。例外的に、遠隔授業(同時双方向)を行う。 遠隔授業は Teams、Zoom等で⾏う。 ※履修登録後に授業形態等に変更がある場合には、TACTの授業サイトで案内します。 In principle, lecture and seminar course subjects are offered in-person. Online participation in classes (interactive communication classes via Teams, Zoom, etc.) may be permitted by the instructor under exceptional circumstances. *Guidance will be posted on TACT if there are any changes in the class format, etc. after registration. |

遠隔授業(オンデマンド型)で行う場合の追加措置 Additional measures for remote class (on-demand class) | | 遠隔授業はTACTで行う。教員への質問方法、学生同士の意見交換の方法は次のとおりとする。なお、教員より別の指示がある場合は、その指示に従うこと。 ・教員への質問は、TACT機能「メッセージ」により行うこと。 ・授業に関する受講学生間の意見交換は、TACT機能「メッセージ」により行うこと。 (※担当教員が「フォーラム」機能を追加設定した場合は「フォーラム」も利用可。) Remote classes are conducted via TACT.
