授業の目的 【日本語】
Goals of the Course(JPN) | | 本セミナーは、現代日本における国家行政組織の変容と民主主義の危機の様相を念頭に置きつつ教育行政学研究・教育法学研究に関わる最新の理論的成果を集団的に検討することを通じ、あらためて公教育と教育行政の基本原理について考察することを目的としている。そのために、国内外の研究書籍・研究論文を講読しすることを基本としつつ、国内法・国際法あるいは判例等も検討の対象の材料とする。当然のことながら検討文献は、最新のものを中心としつつも基本原理を探究するために古典的なものも含まれる。
2023年度は、とくに次の課題に取り組む。
①新自由主義・緊縮財政政策下における国家行政組織の変容と分担管理原則の空洞化過程分析
②その具体的な制度問題のひとつである子ども家庭庁とデジタル庁の行政組織論的分析と国際法の合意水準をふまえたこども基本法解釈
③新自由主義改革と対置される近年の福祉国家再評価に関する海外文献の動向調査および福祉国家論における教育行政組織の基本原則の解明 |

授業の目的 【英語】
Goals of the Course | | The purpose of this seminar is to collectively examine the latest theoretical achievements in educational administration and educational law research, keeping in mind the transformation of state administrative organizations and the crisis of democracy in contemporary Japan, and to consider the basic principles of public education and educational administration once again. For this purpose, we will read books and research papers from Japan and abroad, while also considering domestic and international law and judicial precedents. Naturally, the literature to be reviewed will be mainly the latest, but will also include classic works in order to explore the basic principles.
In FY2023, the following issues will be addressed in particular;
(1) Analysis of the transformation of state administrative organizations under neoliberalism and fiscal austerity policies and the hollowing out process of the principle of shared management
(2) An analysis of the administrative organization of the Administration for Children and Families and the Digital Agency, one of the specific institutional issues, and an interpretation of the Basic Law for Children in light of the agreed level of international law
(3) A survey of foreign literature on the recent reevaluation of the welfare state in opposition to neoliberal reforms and an elucidation of the basic principles of educational administrative organization in the theory of the welfare state |
