Goals of the Course
Purpose and Description
This course provides an examination of international law concerning economic globalization, focusing on: an overview of the fundamental elements of the law on the World Trade Organization (WTO) as the main aspect of global economic order; and the challenges the current international economic law order faces amidst the ‘backlash’ against economic globarisation. The first half of the course provides a brief introduction to the history and evolution of the legal framework for trade liberalization and investment protection. It then proceeds to examine certain fundamental principles and functions of WTO law, focusing primarily on the WTO Agreement on Goods (GATT) and on the WTO Dispute Settlement Understanding (DSU), together with the difficulties the WTO system currently experiences. It then proceed to discuss specific topics that demonstrate the tension between international economic law and the global trend of nationalism that has also led to the backlash against economic globalization.

Achievement Target
By taking this course, students are expected to obtain both the basic knowledge of international trade law – including a critical mass of case-law – and the skills which will enable them to analyze to what extent regulatory measures that have impact on international trade are consistent with these laws. Students are also expected to learn the basis for the analysis of issues of controversy, including the possible conflicts between national security and economic globalization. In sum, students will be able to obtain a good understanding of the most important aspects of international trade law, as well as the skills of critically assessing and analyzing the impacts and the prospects of economic globalization.

4. Dispute Settlement under the WTO (1): jurisdiction of the WTO dispute settlement system, key features of WTO dispute settlement
5. Dispute Settlement under the WTO (2): institutions and process of WTO dispute settlement, remedies for breach
6. Rules on Trade in Goods (1): market access - scheduling concessions in the GATT
7. Rules on Trade in Goods (2): The principle of non-discrimination (the most-favoured-nation (MFN) treatment and national treatment (NT))
8. Rules on Trade in Goods (3): General Exceptions and Security Exceptions
9. Other rules of the WTO law: GATS, TRIPs
10. Regional trade agreements: CPTPP as an example
11. Backlash against economic globalization (1): WTO in crisis - reasons, the status quo and prospects
12. Backlash against economic globalization (2): FDI screening (Japan as an example) and trade war
13. Backlash against economic globalization (3): national security v. trade rules
14. Backlash against economic globalization (4): competition over cybersecurity governance
