本講義は、留学生ならびに日本人学生を対象に日本の民事裁判手続の概要を説明し、これについて理解を深めて、それぞれの専門分野の勉強に活かすことを目的とする。

Goals of the Course
The aim of this lecture is to explain an outline of Japanese civil litigation procedure, understand its system and apply to each field of research both for International and Japanese students.

The goal of this lecture is to acquire the terminology in Japanese civil litigation system, the flow of its procedure and the theoretical issues in order to appy to each theme of the research.

3. Training system for lawyers in Japan
1) Comparison of the proportion of lawyer population between countries
2) Training for lawyers and the Law School
3) Education of required facts (in relation with civil law, commercial law and civil procedure law)
4) Recognition of facts

4. Flow of the procedure for civil litigation
1) Maintenance of civil case
2) Civil trial (civil procedure and non-contentious litigation)
3) Enforcement of civil cases (compulsory execution and execution of security interests)
4) Different bankruptcy systems
5) ADR (reconciliation made in and authorized in the court, civil mediation, family mediation, arbitration, others)

遠隔授業は基本的にはNUCTで行う。教員への質問方法、学生同士の意見交換の方法は次のとおりとする。なお、教員より別の指示がある場合は、その指示に従うこと。
・教員への質問は、NUCT機能「メッセージ」により行うこと。
・授業に関する受講学生間の意見交換は、NUCT機能「メッセージ」により行うこと。
(※担当教員が「フォーラム」機能を追加設定した場合は「フォーラム」も利用可。)
Remote classes are conducted via NUCT basically. Questions to instructors should be asked using the NUCT "Message" function.
