授業の目的 【英語】 Goals of the Course | | This course is designed for international students coming from different countries and having different backgrounds. In this course, you are going to learn different legal systems and institutions and how to compare them. In addition, you are expected to explain them clearly for the other participants who have not had the same assumptions and histories. This course consists of combined styles: lecture-style and seminar-style. In the lecture parts, lecturers provide the participants with the framework and viewpoint to some degree. In the seminar part, each participant is expected to make presentation twice: mini-presentation and presentation. In the mini-presentation, you explain your chosen topic in 5 minutes, and then you will be given some comments from the others. Based on those comments, you should prepare for your next presentation. In the presentation, you explain your chosen topic in 30 minutes. |

授業の内容や構成 Course Content / Plan | | (1) Lecturers will provide course guidance. At that time, you introduce themselves and your research interests in the 1st lecture (2) Lecturers will teach basic point of views from which you make a presentation: especially those are related to necessary elements for modern legal system, rule of law and justice to access in the 2nd and 3rd lectures. (3) You should pick up your theme in the following ones Topics: Modernization, Legal Education, Independence of Justice, Crime, Punishment, Contract, Private Property, Family including children, Gender, Freedom of Expression, Discrimination, Privacy, Methods of Legal Interpretation, Lawyers, Ethics of Lawyers, Judicial System, E-Justice, Platform, Rule of Law, and so on.
(4) You are expected to make two presentations: a mini-presentation and a presentation. (A) MINI-PRESENTATION: it consists of 5-minutes presentation and 10-minutes comments from participants. You talk about your chosen theme and which kinds of books/articles you will pick up in 5 minutes presentation. Other participants will make comments on that in 10 minutes. (B) PRESENTATION: it consists of 20-minutes to 30-minutes presentation. After your mini-presentation, you will prepare for your presentation in accordance with given comments there.
1. Introduction (1) Guidance to this course. (2) Self-introduction by participants: who you are and what a kind of research interest you have. (3) Concise explanation about the themes which participants can pick up.
2. Modernization of Law and Rule of Law in Japan Lecture by Professor Yo Matsuo (1) Modernization of Law in Japan and its Problems. (2) Rule by Law/Rule of Law. (3) Q & A session.
3. Dispute Resolution and Justice to Access Lecture by Professor Masako Murakami (1) Dispute Resolution. (2) Justice to Access. (3) Q & A session.
How often and long we hold mini-presentations and presentations depends on the number of participants.
4. Mini-Presentation (1) Mini-presentation by each participant. (2) Comments and questions from the others.
5. Presentation (1) Presentation by each participant. (2) Group discussion (whether this is held depends on the number of participants). (3) Total discussion. |

成績評価の方法と基準 Course Evaluation Method and Criteria | | (1) Class Participation (30 %) (2) Mini-presentation (10 %) (3) Presentation (20 %) (4) Final Paper (40 %) * The final paper should be written based on your (mini-)presentation. These factors will be evaluated in light of the standards set out in the column "Course Targets". |
