Goals of the Course
"Comparative Law II" focuses on the legal system in Asian countries, especially Southeast Asian countries. As the Asian legal system is new for most participants and Asian law study demands a different legal perspective from conventional legal studies, the first part of the course discusses the concept of law across the world and the expansion of western law in the modern age while conflicting indigenous norms that already existed in Asian societies. After the introductory part, this course will mainly discuss constitutional laws in societies of Southeast Asia. In Asian countries, constitutions reflect the national identities and people's notions of how the law should be in the country.

Objectives of the Course
By studying this course, students are expected to be able to identify characteristics and problems of law in Asian countries which have unique cultural and historical backgrounds, economic challenges, and various political regimes. Participants should compare Asian constitutional laws with countries of other regions and understand the general situation of law in non-Western societies through the discussion in this course.

2-3. The law in various worlds: From the viewpoint of Islamic law
4. The law in various worlds: From the viewpoint of Chinese law
5. The law in various worlds: From the viewpoint of Japanese law
6. The concept of law: the concept of "right" and the function of law in the non-western world
7-8. The constitution: historical development and different types of the constitution
9-10. The elements of the constitution: human rights and judicial review
11-12. Overview of Southeast Asia and its various legal systems
13-14. Case studies on the constitutions in Southeast Asia
15. Discussion

講義日は、TKCシステムを参照のこと。

Course Prerequisites and Related Courses
There is no precondition to take this course. Basic knowledge of law (undergraduate level) is preferable but not mandatory to participate in this course.
成績評価の方法と基準
Course Evaluation Method and Criteria
Mid-term assingment 40%, End-term assingment 40%, Contribution to class 20%.
Credit is given to C- or C (where applicable) or higher grade for each criterion.
成績評価(合否判定及び成績の区分)は、名古屋大学法科大学院が教育課程方針に基づいて策定した評価基準に従って行う。
