授業の目的 【日本語】
Goals of the Course(JPN) | | 日本国憲法の人権規定をその後の国際人権法の発展と諸外国の憲法判例を踏まえて検討することは憲法学の発展にとって有意義である。この授業ではできるだけ包括的、的確に日本国憲法の人権を理解することをめざす。また、日本では法の支配や法治主義の不足が外国人の人権の発展を妨げていることにも留意する。その際、憲法学を越境して、国際人権法、移民政策研究の領域に踏み込むことも必要となるだろう。受講生の憲法の認識を深めるようなものでありたい。

授業の目的 【英語】
Goals of the Course | | Reexamining the human rights provisions of the Constitution of Japan in light of subsequent developments in international human rights law and comparative constitutional jurisprudence is highly valuable for the advancement of constitutional scholarship. In this course, we aim to grasp the human rights of the Japanese Constitution as comprehensively and precisely as possible. Noting that deficiencies in the rule of law and Rechtsstaatlichkeit have hindered the development of the human rights of non-citizens in Japan. In doing so, it will be necessary to transcend constitutional law and enter the fields of international human rights law and migration policy studies. I hope that the course will deepen the students' understanding of the Constitution.

Objectives of the Course | | "Through this course, students will deepen their understanding of the following themes:
1) the relationship between the human rights provisions of the Constitution of Japan and international human rights law; 2) comparative perspectives drawn from constitutional case law in other jurisdictions; 3) issues arising in Japanese constitutional jurisprudence when examined from the standpoint of fundamental principles such as the rule of law and Rechtsstaatlichkeit; 4) challenges concerning the protection of the human rights of non-citizens; and 5) key issues in Japan’s migration policy."

Course Content / Plan | | 第１回 法の支配の不足と外国人の人権、第２回 人権の享有主体性、第３回 人権の制約根拠と比例原則、第４回 幸福追求権とは何か、第５回 平等の現代的意義、第６回 適正手続と外国人の人権、第７回 社会権と外国人の人権、第８回 国際人権法上の人権と憲法の不文の人権、第９回 恣意的な国籍剥奪禁止、第10回 庇護権と補完的保護、第11回 恣意的な収容の禁止と品位を傷つける取扱いの禁止、第12回 ヘイトスピーチの禁止、第13回 難民申請者の裁判を受ける権利と行政の適正手続、第14回 外国人の参政権と公務就任権、第15回 インターカルチュラリズム。

成績評価の方法と基準
Course Evaluation Method and Criteria | | 授業における報告の出来具合（70%）、ディスカッションへの参加度、貢献度（30％）にもとづいて評価する。報告およびディスカッションにおいて、日本国憲法および国際人権法についての的確な理解が示されていることを合格の基準とする。

Textbook | | 近藤敦『人権法（第3版）』（日本評論社、2025年）、同『国際人権法と憲法』（明石書店、2023年）、および近藤の論文を教材として使用する。論文は受講生に配布する。
